Kafka's Last Trial: The Case of a Literary Legacy

Review

“Fascinating and forensically scrupulous.” - John Banville, The Guardian“Dramatic and illuminating....raises momentous questions about nationality, religion, literature, and even the Holocaust.” - Adam Kirsch, The Atlantic“Thoughtful and provocative.” - Ruth Franklin, Wall Street Journal“A gifted cultural historian with a scholarly sensibility.” - Lev Mendes, New York Times Book Review“Absorbing....Balint elegantly intercuts courtroom scenes with episodes from Kafka’s biography and cultural afterlife. He brings out every paradox of a judicial process that tried to tie down this most ambivalent of authors, the ultimate 'disaffiliated pariah,' to a fixed identity....Balint’s scrupulous and sardonic prose makes you love Kafka, and dread the law.” - The Economist“A tale pitting two Goliaths against one octogenarian David, untangled in exacting, riveting detail....A must-read.” - Rebecca Schuman, Slate“Though Benjamin Balint’s masterful hunt for Kafka’s rightful ownership begins as a local dispute in an Israeli family court, it soon thickens into modernity’s most bitterly contentious cultural conundrum. Who should inherit Franz Kafka? The woman into whose hands his manuscripts fortuitously fell? Germany, the nation that murdered his sisters but claims his spirit? Israel, asserting a sovereign yet intimate ancestral right? Searing questions of language, of personal bequest, of friendship, of biographical evidence, of national pride, of justice, of deceit and betrayal, even of metaphysical allegiance, burn through Balint’s scrupulous trackings of Kafka’s final standing before the law.” - Cynthia Ozick, author of Foreign Bodies“Thrilling and profound, Kafka’s Last Trial shines new light not only on the greatest writer of the twentieth century and the fate of his work, but also on the larger question of who owns art or has a right to claim guardianship of it. Benjamin Balint combines the sharp eye of the courtroom journalist with the keen meditations of a literary and cultural thinker, and his research and lively intelligence deliver insights on every page.” - Nicole Krauss, author of Forest Dark“Kafka’s Last Trial is a fascinating inquiry into―and meditation on―the nature of artistic genius and the proprietary claims any one individual or country has on the legacy of that genius. Benjamin Balint is both a superb investigative journalist and a gifted cultural critic. This is that rarest of books: a scholarly work that is also compulsively readable.” - Daphne Merkin, author of This Close to Happy“Superb....Beautifully crafted, with just the right ratios of empirical-legal information, intellectual history, critical awareness of Kafka and his work, and wise reflection. It is obviously the product of admirably patient research and rare dedication to quality control.” - Stanley A. Corngold, Professor Emeritus of German and Comparative Literature, Princeton University

A beautifully written and researched book on the fate of Franz Kafka's literary papers. While Benjamin Balint, the author, capably leads the reader through the complicated legal proceedings that ultimately decided where the papers saved by Kafka's friend Max Brod would ultimately reside, the real value of the book is the thought provoking passages on why national libraries in Germany and Israel sought the papers; why Brod's secretary and daughters came into this picture; why there is dispute over the extent of Jewishness in Kafka's prose; why (or if) one country or another "owns" an international author; and much more. This book will win prizes.Readers searching for more on Kafka, himself, would benefit by buying and reading the three-volume biography written by Reiner Stach and translated into English by Shelly Frisch.

This is a great book. At its core, it is about the legal dispute over Kafka’s work but that is a small part of the book. The larger story is about Kafka and Max Brod’s lives and how societies try to claim cultural memory. It is a very though provoking tome on who “owns” what and why it matters. This is a fascinating read. I couldn’t put it down.

While this is ostensibly about the court case surrounding the ownership of the literary estate of Kafka and of Max Brod, his literary executor, it covers and examines a much broader canvass: the legal issues of who owns a literary heritage; the intellectual and emotional lives of both Franz Kafka and his friend Max Brod; why both Israel and Germany vied for Kafka's manuscripts; why Kafka never really caught on in Israel; Max Brod's life as an intellectual exile in Tel-Aviv, and more. The book is rich, very well written, very well constructed and excellently researched.A tour de fotce for any interested in Kafka and related issues, not least the whole Central European, German-speaking (largely Jewish) twentieth century intellectual milieu. Highly recommended.

Part courtroom drama, part literary history, part international intrigue this is a compelling book. Balint, whose previous work was an accomplished and engaging exploration of Commentary Magazine’s historical transformation, has here given us an insightful look at the complex relationship between Kafka and Max Brod. And the aftershocks of that relationship. What is the meaning of literary legacy? Who owns art? Does Germany have a claim on the works of a Jewish artist? Does Israel even if the artist was never a Zionist? Balint puts all these questions in play and does it with brio and spirt wrapped in courtroom drama. And I would be remiss not to mention the book is also wonderfully entertaining.

Among the many fascinating issues raised by Benjamin Balint in his latest book, I found the topic of what defines a Jewish writer to be most intriguing. Balint deals deftly with Kafka's (ambivalent) Jewish identity and the struggle by Germany and Israel to claim his legacy. Painstakingly researched and written in an engaging style, this is a must read.

COUNTER-REVOLUTION OF SCIENCE, THE

Early in the last century the successes of science led a group of French thinkers to apply the principles of science to the study of society. These thinkers purported to have discovered the supposed 'laws' of society and concluded that an elite of social scientists should assume direct control of social life. The Counter-Revolution of Science is Nobel Laureate Friedrich Hayek's forceful attack on this abuse of reason.

A brief but deep book. Hayek shows he is far more than an economist. Lots of overlap with Karl Popper. Also, touches on themes from "The Use of Knowledge in Society"."Many of the greatest things man has achieved are not the result of consciously directed thought, and still less the product of a deliberately co-ordinated effort of many individuals, but of a process in which the individual plays a part which he can never fully understand."

The other reviewers on Amazon have done an excellent job summarizing the main points in this book. I will briefly contribute to this discussion by detailing the arguments that stood out to me.First of all, the book is dividied into two sections: (1) Scientism and the Study of Society; and (2) The Counter-Revolution of Science. The former expounds the differences and peculiar histories of both the social and natural sciences, while the latter seeks to understand the historical development of "scientism", finding its roots in the rationalistic tradition of French (continental) thought. The first part is the more important section, and should be read carefully. Hayek traces the long escape of natural science from the anthropomorphic thought that characterized the Middle Ages. External events were believed to possess some transcendental reality. Slowly, however, science began to discover explanations of external reality that differed from our common sense perceptions. "Facts", it was argued, are different from "appearances." Note that in this discussion Hayek is not attacking the character of science when it is conducted in its own proper sphere. Science has much to say about the relation of material things to other things (cause and effect, etc.). Scientific study errs, however, when it begins to substitute material explanations for human affairs. There are some phenomena that cannot be explained by their material characteristics. In fact, most phenomena involving human opinions and beliefs cannot be explained by natural science. Hayek gives several illuminating examples to illustrate his case: "words", "sentences", "crimes" "family", "exchange", "money" etc. clearly can only be understood by finding out what people think about these things and not from their objective characteristics. In this book Hayek shows that the social sciences are fundamentally distinct from the natural sciences because men can only be understood through their beliefs and opinions. A very important work.

The Counter Revolution of Science is an important book for several reasons. First, The CRS explains the futility of schemes to plan progress, the impossibility of efforts for the "human mind to lift itself up by its own bootstraps". What this means is that "the attempt of conscious reason to control its own development limits the very growth to what the human mind can could foresee". Freedom "releases the knowledge and energies of countless individuals that could never be utilized in a society consciously directed from the top". Second, the CRS explains how the mindset of the physical sciences, which focuses on objective factors, fails when applied to economics. Understanding economics requires an appreciation of subjectivity in human relations. Engineers pursue technical excellence according to objective scientific principles, without considering economic factors (i.e. scarcity), and worse still the application of mathematical methods from the social sciences creates a false and dangerous impression that society can itself be engineered. Third, Hayek examines the history of the development of `scientistic' ideas, whereby various thinkers (especially St Simon and Comte) popularized positivism, socialism, and corporatism. Finally, reading the CRS instills an appreciation of the humility of individualism and disdain for the hubris of collectivism in the reader.Generally speaking, Hayek makes the importance of recognizing and respecting the limits of human reason abundantly clear. Hayek saw that modern collectivism was working to undo the intellectual progress made during the Age of Reason and the Enlightenment. Collectivism was antithetical to reason, and would lead us to a new Dark Age if not reversed. Persons of the left with surely find this absurd, and their revulsion to Hayek's thesis is consistent with his thesis. The Left does not reject reason explicitly, it abuses reason unwittingly. People on the Left truly believe that they are progressive and scientific, but this is a false belief. Socialists and Welfare State Liberals abuse human reason by failing to see its limits. The background to this book is simple. Hayek started his career writing technical economics. Hayek's efforts were initially met with success. Hayek initially swayed professional opinion on business cycles. Hayek also forced socialists to revise their early proposals. Yet professional opinion turned against Hayek during the mid thirties. Why? Had they proved him wrong? Did they fail to understand why he was right? How was it that intelligent and educated people could not see the strength of Hayek's arguments? Hayek's technical economics show how the capitalist system functions. Yet Hayek misunderstood the way in which his peers understood the term `technical economics'. That is, Hayek erred by underestimating the influence of positivist and other ideas. Hence Hayek turned to explaining why economists and other educated people were unable to understand correct economic theories: they had embraced a false notion of rationalism.I find the sections on Engineers particularly interesting. Hayek's views on the role of engineers in society are so diametrically opposed to Veblen's Engineers and the Price System that one must wonder why he did little more than mention Veblen in passing. The Counter Revolution of Science is one of Hayek's best books, and that is saying a lot. The Counter Revolution of Science was important in the twentieth century because it penetrated to the core of intellectual problems of that time. We live in a new century now, but the old problem of abusing reason remains. One need only look at the policies of Bush/Cheney and Obama/Emanuel to see how the social engineering mindset prevails in modern America. The CRS represents Hayek at his best, insightful, informative, and well reasoned in his conclusions. These are important ideas too, given that people still believe in false notions of rationalism, whereby most people still trust that the so-called best and brightest can best plan society. The Counter Revolution of Science should be read by the entire educated public.

Half review of modernists approaches to science (also exposing Hayek's own view) and half a comented historical account on the modernists' approach to science

Was unable to read more than a small amount. Was excruciatingly dry and abstract, to the extent that I couldn't register any particular point that he was trying to make.

This is the final book in the His Fair Assassin trilogy and I finally feel that I got the book I wanted from the start. ‘Mortal Heart’ is the story of Annith who along with Ismae and Sybella, from book one and two respectively, grew up together in the Convent of Saint Mortain. Mortain is the god of death, but in ‘Mortal Heart’ Christianity has reduced his importance by calling him a saint and incorporating some of his mythos into their religion. He is one of the Nine Gods of Brittany and in this installment Ms LaFevers delves into this world and brings a lot more fantasy elements than the two previous novels combined.Firstly, I really liked Annith, and whilst her backstory wasn’t as dark as Sybella’s I still felt that her childhood moulded her into the woman she was and allowed the reader to understand her motivations. The Abbess has decided that Annith is to become the new seeress, a future that Annith finds repugnant. She has trained her whole life for one thing, to become an assassin in the name of Mortain and longs to be able to prove herself. This drives a lot of the narrative, Annith’s need to prove to the Abbess and Mortain that she can be his divine instrument. The first 20% of the book Annith is at the Convent and the story is heavy with detail and exposition that can be a little tedious. However, after that the pace picks up nicely and I found myself being pulled along with Annith in her adventures. We get to meet her love interest, Balthazaar, early in the story and unlike the previous two novels I found that the relationship unfolded at a reasonable pace. It was still a very short jump from meeting to realising they loved each other but the empathy of Annith and kindness of Balthazar won me over in the end.The story also has a lot more action which I preferred to the dry political maneuverings of ‘Grave Mercy’. Whilst there were still elements of the conflict that arose in the late 1400’s with the crowning of Duchess Anne, her many suitors and the threat of French invasion, it didn’t overwhelm the story-line. Rather it provided nice plot points for the story as Annith tries to serve Mortain whilst helping Duchess Anne and discovering what the Abbess is planning. We get to see Ismae + Duval and Sybella + Beast again which should satisfy fans of ‘Grave Mercy’ and ‘Dark Triumph’. Other secondary characters like Duchess Anne, The Abbess and Viscount Crunard are also more fully developed. The mythology around the Nine Gods is also expanded and we get to meet The Hellequin and the Followers of Saint Arduinna.Overall, I felt like the story stopped relying so heavily on historical accounts and elucidation and incorporated more fantasy and even romantic elements leading to a more satisfying blend than the previous two novels.4.25/5 Stars! The Assassin Nuns finally come into their own!

I felt sorry for Annith for a good part of the book. All she wanted was to go out and do her duty and serve Death (Mortain) but she has been kept at the convent. She can't understand why, as the best assassin they have, that she is being kept and not sent out on missions. Yeah, I never saw that reason coming, not for a long shot.:Annith misses Ismae and Sybella from the first two books so much and she can't understand why she is still at the convent and not helping them. I already said that, but still. She's just really sad and down on herself.I cannot help it--I laugh. "You think you can best me?"She lifts one shoulder. "I think I would like to know if I could or could not."At her words, my smile wobbles and it is all I can do to keep from throwing my knife down in defeat. Even this child thinks I am not longer a match for her. I carefully avoid looking out at the ocean, just beyond the trees. It is too painful a reminder that both Ismae and Sybella have been sent places I have not, have begun to fulfill their destinies while I am stuck here playing nursemaid to a gaggle of budding assassins. When Annith learns of what the abbess wants her to become she decides to set out on her own. She runs into some interesting people on the way to her destination. One would be the hellequins <--- I hope I spelled that right. They are immortals that basically go around and get lost souls to cross over and they are a rough bunch. They are trying to redeem themselves of bad things they had done in their past lives.Annith meets Balthazaar, the leader of the hellequins and they have some chemistry. I thought he was hot, just sayin. Then Annith gets some things into her head and runs away and ends up meeting a group of warrior women called the Arduinnites. They were really nice to her but they brought some really sad news to Annith and now she is on a mission to kill.Annith finally makes it to Sybella and Ismae, she tells them of some things she thinks is peculiar in the covent. Something is up with the abbess and it's more than I would have thought. That was a pretty deep revelation when I got to it.And in this book we also find out more about Mortain and who he really is and OMG, I loved it! It was one of those holy crow moments that everyone else probably figured out but me!Either way, I enjoyed all of the books in this trilogy! How often do you read about bad to the bone butt kicking nuns that will take you out?

Review

One of Boston Globe’s Best Books of 2018 One of San Francisco Chronicle’s 10 Best Books of 2018 One of Kirkus Reviews’ Best Books of 2018Featured in Mother Jones’ Favorite Nonfiction of 2018     “American Prison reprises [Bauer’s] page-turning narrative [as reported in Mother Jones], and adds not only the fascinating back story of CCA, the nation’s first private prison company, but also an eye-opening examination of the history of corrections as a profit-making enterprise . . . Bauer is a generous narrator with a nice ear for detail, and his colleagues come across as sympathetic characters, with a few notable exceptions . . . The sheer number of forehead-slapping quotes from Bauer’s superiors and fellow guards alone are worth the price of admission.” —The New York Times Book Review   “American Prison is both the remarkable story of a journalist who spent four months working as a corrections officer, and a horrifying exposé of how prisoners were treated by a corporation that profited from them. . . . It’s Bauer’s investigative chops, though, that make American Prison so essential. He dedicated his time at Winn to talking with prisoners and guards, who were unaware that he was a journalist . . . Based on his first-hand experience and these conversations, he paints a damning picture of prisoner mistreatment and under-staffing at the prison, where morale among the incarcerated and the employees was poor. The stories he tells are deeply sad and consistently infuriating . . . An enraging, necessary look at the private prison system, and a convincing clarion call for prison reform.” —NPR.org    “A relentless and uncompromising book, one that takes a crowbar to the private prison industry and yanks hard, letting just enough daylight slip inside to illuminate the contours of the beast . . . The private prison industry is booming once again. To find out what that means for real people—both those who guard and those who are guarded—American Prison is the place to begin.” —San Francisco Chronicle                                                                  “[Bauer] exposes the extreme inhumanity and myriad abuses perpetrated by the American prison system—problems that effect both prisoners and guards. A terrifying look into one of America’s darkest and deepest ongoing embarrassments.” —LitHub “One of the most incisive — and damning — investigations into prison culture and business in recent memory, Bauer’s illuminating hybrid memoir and sociological study shines much-needed light into some dark corners of the criminal justice system.” —Boston Globe    “Riveting . . . Bauer himself was held in an [Iranian] prison for two years, so he knows what it feels like to be on the inside, yet he brings to the text a journalist's purview and draws a direct line between American slavery, the founders of the prison corporations and the job he is hired to do. In a fascinating tightrope walk, Bauer shows that, in this so-called industry, the financial bottom line comes at a high human cost.” —Oprah.com    “The searing details of [Bauer’s] time in the Winn facility form the brutal core of his indictment: evidence of systematic cruelty and profiteering that starts to erode the morality of prisoners and guards alike.” —Vulture  “A penetrating exposé on the cruelty and mind-bending corruption of privately run prisons across the United States . . . Nearly every page of this tale contains examples of shocking inhumanity . . . A potent, necessary broadside against incarceration in the U.S.” —Kirkus, starred review “Deprivation, abuse, and fear oppress inmates and guards alike in this hard-hitting exposé of the for-profit prison industry . . . A gripping indictment of a bad business.” —Publishers Weekly, starred review   “Bauer’s amazing book examines one of slavery’s toxic legacies, using convicted people to make profit . . . He observes an acutely dangerous and out-of-control environment created by CCA’s profit-driven underpaying of staff and understaffing of prisons. Bauer’s historical and journalistic work should be required reading.” —Booklist “Sometimes the only way to get the full story is to put yourself into it as an ‘immersion journalist.’ Shane Bauer wanted to know more about for-profit prisons so he got a job in one as a correction officer, or guard, and reports his experiences grippingly while weaving in the social and economic factors that give rise to these horrors. His book reveals much that that we didn’t want to know about but, having learned about, can never forget.” —Barbara Ehrenreich, author of Nickel and Dimed   “American Prison is a searing, page-turning indictment of America's practice of corporate incarceration. Shane Bauer reports in the best way a journalist can: by going into a prison himself. But then he connects the dots, drawing a persuasive through-line from plantations worked by slaves, to Southern prison farms, to corporate prisons. With this braid of history and reportage Bauer reveals the criminal nature of private prisons, a world of pain that is also a business. His is a beautiful rage.” —Ted Conover, Pulitzer Prize finalist and director of the Arthur L. Carter Journalism Institute of New York University

I got my copy of American Prison last night and literally could not stop reading it until I was finished. Shane Bauer did a heroic job infiltrating a for-profit prison and giving us an inside perspective on one of the most violent and exploitative industries in America. It helps that American Prison is a complete page turner. Get your copy now, before it inevitably gets turned into an award-winning HBO series!

If you are not a consistent reader of "Mother Jones," you may have missed their original expose of conditions inside contemporary for-profit prisons in America. A lot of us should read "American Prison" to learn more about what is being done in (some of) our names.Bauer went undercover, in his own name, as a guard in a for-profit prison operated by CCA (Now CoreCivic). He ties his experience in CCA's Winn Correctional Center into America's century-plus history, primarily but not exclusively in Southern states, of using convict labor to bridge the gap created by the end of slavery. Factor in for-profit prison operators, and you create an environment perfect for the dehumanizing of convicts and correction personnel alike. How does CCA make a profit on contracts that pay as little as $24 per inmate per day? CCA pays guards at its Winn LA facility $9 an hour, less than local burger flippers earn. Guards work for years with no raises but plenty of mandatory overtime because hiring (Even with virtually no minimum competency standards) can't keep up with attrition. Units are consistently understaffed with two guards assigned for upwards of 500 inmates. Social services and mental health programs are virtually non-existent. Medical care? One CCA facility has a 20-hour-per week physician for 1,400 inmates. Education? Rehabilitation?CCA's stock price took a hit when the Obama administration announced it would discontinue using for-profit prisons for federal detention. But investors needn't worry--that price recovered and more the day after Trump was sworn in.The ghastly conditions of plantation prisons--where 1 in 5 convicts died each year--are worse than you thought. And so are the outcomes of for-profit prisons. More violence, more suicides, higher recidivism, more civil rights violations.A sobering look in the prison and corporate hallways most of us will never have directly.

His story of working in the prison is a page turner. But every other chapter is on the history of slaves, freemen both white and black. Descriptions of the working and living conditions were unbelievable. Surely the people of the South can't be proud of that history. I had my doubts about for profit prisons and this book confirms them.

This book is *gripping.* It alternates between Bauer’s undercover work as a guard at a private prison and a fascinating deep-dive into the history of the prison labor system growing out of the slave system. It’s just so well-reported and well-written and so disturbing.I know Shane Bauer through his other book, his reporting for Mother Jones, and his important social media presence. One thing I respect about him is that he’s not afraid to spit out truth even when it’s unpopular or would offend the sensibilities of our time. This book is no different. It takes a deep undercover look at Winn Correctional Center and at the history of prisons for profits in general, but Bauer is just as critical of himself as well, and pulls no punches in describing how his experience participating in the prison system negatively affected him, and the catch-22 he found himself in while trying to navigate an oppressive system he didn’t really buy into but increasingly felt the need to participate in. His honesty is refreshing, and is something (I assume) that anybody who’s socially conscious but has been in a position of authority can relate to.The history of for-profit prisons was raw and intense without being preachy. I think if Bauer was teaching history classes, more students would pay attention.I didn’t read a lot of books this year, but am really glad I read this one. Highly recommended.
